Refund Policy

This Refund Policy explains the conditions under which customers may request a refund for digital products purchased from Apexion Solutions Ltd ("Apexion", "we", "us", or "our"), a company registered in England and Wales under company number 17425862, with its registered address at 50 Princes Street, Ipswich, United Kingdom, IP1 1RJ.

This Policy applies to purchases made through apexionwp.com (the "Site") and should be read together with our Terms & Conditions and Privacy Policy.

We aim to provide customers with reliable digital products, transparent purchasing conditions, and a fair refund process. Nothing in this Policy excludes or restricts any mandatory consumer rights provided under applicable law.

1. Digital Products and Delivery

Apexion offers downloadable WordPress themes, templates, and related digital website resources. All products are supplied electronically. No physical products are shipped.

Following successful payment confirmation, purchased digital products are normally made available immediately through the customer's personal account dashboard on the Site.

Customers also receive an email confirmation containing their order details and information or links for accessing the purchased digital files.

Customers can access their purchased products by logging into their registered account and navigating to the relevant purchases or downloads section.

Electronic delivery may occasionally be affected by payment verification, maintenance, email filtering, or temporary technical issues. If purchased files are not accessible following successful payment, customers should contact our support team.

2. Refund Request Period

Customers may submit a refund request within 14 calendar days of the purchase date for consideration under this Policy.

Submitting a request within this period does not automatically guarantee a refund. Eligibility depends on the circumstances of the purchase, the status of digital delivery, and any applicable statutory rights.

Where a customer has a statutory right to cancel, the applicable cancellation period and legal requirements will govern that right.

Requests submitted after the 14-day period may still be considered where required by applicable consumer protection law, including where digital content is faulty, materially different from its description, or has not been supplied as agreed.

3. Right to Cancel Digital Content Purchases

Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, eligible consumers generally have a 14-day right to cancel a distance contract for digital content, beginning on the day after the contract is concluded.

For digital content supplied without a physical medium, the statutory right to cancel may be lost once supply of the digital content has begun before the end of the cancellation period, provided that the consumer has:

  • Given prior express consent to the supply of digital content beginning during the cancellation period.
  • Expressly acknowledged that the statutory right to cancel will be lost once supply begins.
  • Received the legally required confirmation of the contract, including confirmation of that consent and acknowledgement, on a durable medium.

Where customers choose immediate digital delivery, Apexion will seek the required consent and acknowledgement before beginning supply during the statutory cancellation period.

Merely visiting the Site, placing an order, or logging into an account does not by itself constitute the specific express consent and acknowledgement required for the loss of the statutory cancellation right.

If the applicable requirements for the loss of the cancellation right have not been satisfied, the customer's statutory cancellation rights and any related refund entitlement remain unaffected.

Nothing in this section limits a customer's separate statutory rights where digital content is faulty, not as described, or otherwise fails to meet applicable legal requirements.

4. Circumstances Eligible for Refund or Other Remedies

Customers may be entitled to a refund, repair, replacement, price reduction, or other appropriate remedy, depending on the circumstances and applicable law.

Relevant circumstances include:

  • Non-delivery: payment has been successfully completed, but the purchased digital product has not been supplied or made accessible within the agreed timeframe, and the issue has not been resolved.
  • Corrupted or unusable files: the supplied files are defective or cannot be used as intended due to an issue with the supplied digital content.
  • Material misdescription: the purchased product differs materially from its advertised description, specifications, or agreed functionality.
  • Duplicate charges: the customer has been incorrectly charged more than once for the same purchase.
  • Incorrect product delivery: the customer receives a different digital product from the one ordered and the error is not appropriately corrected.
  • Unauthorised transactions: a payment was not authorised by the relevant payment account holder, subject to applicable payment services rules and appropriate investigation.
  • Valid statutory cancellation: the customer exercises an applicable right to cancel within the relevant cancellation period.
  • Other legal entitlements: circumstances in which a refund or other remedy is required under applicable consumer protection law.

We may request relevant order information, screenshots, error messages, or other reasonable details to investigate the reported issue.

5. Faulty Digital Content and Consumer Rights

Under the UK Consumer Rights Act 2015, digital content supplied to consumers must meet applicable legal standards, including satisfactory quality, fitness for purpose where applicable, and conformity with its description.

Where digital content does not conform to these requirements, customers may be entitled to repair or replacement within a reasonable time and without significant inconvenience.

If repair or replacement is impossible, or is not provided within a reasonable time and without significant inconvenience, customers may be entitled to an appropriate price reduction, which may in some circumstances amount to a full refund.

Additional remedies may apply where Apexion does not have the legal right to supply particular digital content or where other statutory obligations have been breached.

These statutory rights are not automatically limited to 14 days from the date of purchase and cannot be excluded by this Refund Policy.

6. Circumstances Where Discretionary Refunds Are Not Normally Offered

Where a statutory right to cancel has been validly lost and no other legal entitlement to a remedy applies, Apexion does not normally offer discretionary refunds solely for the following reasons:

  • The customer changes their mind after purchasing and receiving digital content.
  • The customer purchases an incorrect theme or template despite the product being accurately described.
  • The customer decides that the design, layout, or appearance does not meet personal preferences where it corresponds to the advertised description.
  • The customer lacks the technical knowledge necessary to install, configure, or customise WordPress products.
  • The customer's hosting environment does not meet clearly disclosed technical requirements.
  • The customer experiences incompatibility with unrelated third-party plugins, services, or custom modifications that were not represented as compatible.
  • The customer no longer requires the purchased digital product.
  • The customer expects additional development, customisation, or services that were not included in the purchased product.

These circumstances do not remove any statutory remedy where a product is faulty, misdescribed, not supplied as agreed, or otherwise fails to meet applicable legal requirements.

We may consider exceptional circumstances individually and may issue a discretionary refund where appropriate.

7. Third-Party Themes, Templates and Licensing

Apexion offers a curated selection of WordPress themes and templates, including products originally developed by independent third-party suppliers such as Themify and CSSIgniter.

Software components distributed under the GNU General Public License (GPL) remain subject to their applicable open-source licensing terms. Certain images, fonts, demo content, and other assets may be subject to separate licensing conditions or may not be included in the purchased download.

Customers should review the product description, included files, technical requirements, and any disclosed licensing information before purchasing.

The fact that a product originates from a third-party developer does not remove Apexion's obligations to customers under applicable consumer protection law.

Product licensing and intellectual property terms are explained further in our Terms & Conditions.

8. Digital Delivery Records and Order Verification

To process purchases and investigate delivery-related issues, Apexion maintains relevant order and transaction information.

Depending on the functionality of the systems used, relevant records may include:

  • Customer order reference and account identifier.
  • Purchase date and transaction amount.
  • Payment confirmation and transaction status.
  • Purchased product details.
  • Digital download entitlements and account access status.
  • Dates and times when download access was provided, where recorded.
  • Order confirmation and email dispatch information.
  • Download activity records, where available.
  • Customer support correspondence relating to delivery or refund requests.

These records may be reviewed to establish whether payment was successful, whether digital access was provided, and whether a reported delivery issue requires further investigation.

Email dispatch or delivery status does not necessarily establish that a customer opened or read the email. Likewise, payment confirmation alone does not establish that digital content was successfully supplied.

Personal information associated with these records is processed in accordance with our Privacy Policy.

9. How to Request a Refund or Cancellation

To request a refund, report a defective product, or exercise an applicable right to cancel, please contact our customer support team at:

Email: [email protected]

Where possible, please provide the following information:

  • Your order number or purchase reference.
  • The email address associated with your purchase.
  • The name of the purchased product.
  • The date of purchase.
  • A brief description of the problem or reason for your request.
  • Relevant screenshots or error messages, where appropriate.

For a statutory cancellation, a clear statement communicating your decision to cancel is sufficient. You are not required to provide a reason or use a particular form where applicable law does not require one.

We may request additional information reasonably necessary to identify the relevant transaction or investigate a reported technical issue.

10. Refund Review and Resolution

We aim to acknowledge and review refund requests within 5 business days of receipt.

Depending on the circumstances, our support team may:

  • Verify the transaction and purchase details.
  • Check the availability of the purchased digital files.
  • Investigate reported download or installation errors.
  • Provide corrected files or replacement digital content.
  • Offer appropriate technical assistance where available.
  • Approve a full or partial refund where applicable.
  • Explain the outcome of the review and any available next steps.

Our target review timeframe does not extend or delay any statutory deadline for cancellation or refunds.

Where a statutory remedy is required, we will provide it in accordance with applicable law.

11. Refund Processing and Payment Method

Approved refunds will normally be issued using the original payment method used for the purchase, unless the customer expressly agrees otherwise or applicable law requires a different arrangement.

Where a consumer validly exercises a statutory right to cancel, any refund due will be made without undue delay and within the period required by applicable law, normally no later than 14 days after we are informed of the valid cancellation.

Where a refund is due under the statutory remedies for non-conforming digital content, applicable statutory refund deadlines will be followed, including the requirement to provide certain refunds within 14 days of agreeing that the customer is entitled to them.

For discretionary refunds, we aim to initiate payment promptly following approval.

Once a refund has been initiated, the time required for the funds to appear in the customer's account may depend on the payment provider, bank, or payment method.

No refund processing fee will be charged where a refund is required by applicable consumer protection law.

12. Chargebacks and Payment Disputes

Customers are encouraged to contact Apexion before initiating a payment dispute or chargeback so that we have an opportunity to investigate and resolve the issue.

However, nothing in this Policy limits a customer's legal right to contact their bank, card issuer, or payment service provider, dispute an unauthorised transaction, or exercise applicable chargeback or other payment protection rights.

Where a payment dispute is raised, Apexion may provide relevant transaction, order, and delivery information to the payment service provider for legitimate dispute resolution purposes.

Accounts may be restricted where there is reasonable evidence of fraud, deliberate misuse, or security abuse, subject to applicable law. Customers will not be penalised merely for exercising lawful consumer or payment dispute rights.

13. Customer Support and Delivery Assistance

If a purchased digital product is missing from your account dashboard, an order confirmation email has not arrived, or a download fails, please contact our support team.

Before contacting us, customers may wish to verify that:

  • The payment was successfully completed.
  • They are logged into the account associated with the purchase.
  • The purchased product is not already available in the downloads section.
  • The order confirmation email has not been filtered into a spam or junk folder.

We will make reasonable efforts to investigate and resolve reported delivery problems in accordance with our contractual and statutory obligations.

14. Changes to This Refund Policy

Apexion may update this Refund Policy periodically to reflect changes in applicable legislation, payment processes, or digital product delivery procedures.

Any updated version will be published on the Site with a revised effective date.

Changes to this Policy will not retrospectively remove statutory rights or contractual rights already acquired by customers.
